Terms and Conditions for the sailing holiday and sailing events arganised by Wczasy Zeglarskie
I.General rules.
The organizer of sailor events mentioned on the website is Wczasy Zeglarskie. Rights and Duties of the entrants are determine by Civil Code and Statute of Turistic Services and constitute integral part of agreement between the Organizer and Entrant. At the moment of signing the agreement, a person accept all the Terms and Conditiones of the agreement like rights and duties during the event.
II. Contracting an agreement.
1.A person can enter into the contract by making a reservation on the website WczasyZeglarskie.pl. And sending back signed reservation to the adress: Wczasy Zeglarskie, 4 Nelson Gardens, Hounslow, London, TW3 3UL, Great Britain, at the same time contracting person is required to pay registration fee. All parties mentioned by the person who sign the contract in the reservation sheet, are deemed to be the entrants also. Persons under the statutory age of 18 years old, are required to present the consent of a tutor.
2.It is your responsibility to obtain all documents required for your course, to ensure that these are in proper order and to take them with you. Wczasy Zeglarskie. will not be liable if you fail to do so and you will be responsible for meeting any additional costs incurred by reason of such failure.
3.Personal details given by the entrant are used to contract implementation.
4.If there is no exclusion under the contract, price of the sailing event includes: accomodation, food full/half board, care of instructor during the time on the sea.
5.Entrant accepts the fact, in the case of booking the place in the 2,3 or 4 bedroom, if there are avaliable beds, organizor will place another entrants regardless of sex and age in the same room.
6.You are responsible for advising Wczasy Zeglarskie. of details of any medical condition or allergies that you have suffered prior to the commencement of the course and of any medication that you are on that may adversely impact you while on the course. In the event that Wczasy Zeglarskie. in its sole discretion considers that these conditions are likely to create an unreasonable burden on the efficient conduct of the course, Wczasy Zeglarskie. has an absolute right to cancel your booking, in which event the cancellation provisions of section VI(2) will apply.
III. Price, method of payments.
1. At the moment of reservation, from a person willing to contract registration fee is required in the amount of 100 or equally the same amount in PLN.
2.If a person sign the contract 30 days prior to the commencement of the event, the full amount is required. The balance (if any) of any event (the Final Payment) is payable not later than 30 days prior to the commencement of the event. The date for payment of the balance due will be included on the Booking Confirmation.
3. In the event that any fees due remain unpaid within 7 days of the date by which the Final Payment is due, Wczasy Zeglarskie. reserves the right to cancel your booking without any obligation to give you notice thereof.
4. Payments can be made directly on the bank account of the organizor Wczasy Zeglarskie, like in cash, or by credit card.
IV. Rights and Duties during the event.
1.Schedule of the event is in whole facultative, Wczasy Zeglarskie does not take responsibility for any damage or injury whatsoever arising during the leisure time.
2.Entrant of the event is responsible for damage to property or to a person when damage occurs from his/hers conduct or when the entrant voluntarily has contributed to caused damage. All the Yachts are insured, entrant is not responsible for damage to yachts, unless damage to yachts was caused intentionally.
3. Clients accept that they undertake the event at their own risk. Wczasy Zeglarskie is not responsible for any injury or damage that is caused to a client while on the Companys premises, on pontoons, ladders or vessels. All clients participate in courses at their own risk.
V. Policy.
1. The Company carries insurance to cover tuition, public liability and employers liability.
2.It is strongly recommended to have a travel insurance with You, loss of your luggage, passport, illness and health care is not covered upon this contract, also if You are planning on hiring a car while abroad, it is important to have a travel insurance, therefor it is a condition of participation on any Wczasy Zeglarskie. event to maintain full insurance to cover throughout the period of the event. Prior to the commencement of the event, Company requires each client to provide it with full details of the insurance taken out.
VI. Amendment and cancellation by you.
1. Wczasy Zeglarskie. will make every effort to assist you if you wish to alter any previously agreed arrangements. Requests must be made in writing or by fax and signed by the signatory of the booking form, or by email.Written cancellation notices should be sent to Wczasy Zeglarskie, 4 Nelson Gardens, Hounslow, London, TW3 3UL, Great Britain. Recorded delivery is strongly recommended. Cancellations are effective on the day they are received by Devon Sailing.
2. In the event of a cancellation being notified to Wczasy Zeglarskie. more than 30 days prior to the commencement of the event, 90% monies paid will be refunded. In the event that the cancellation is notified to Wczasy Zeglarskie. Between 20-29 days prior to the commencement of the event, client will be refunded 60% of the amound paid. In the event that the cancellation is notified to Wczasy Zeglarskie. Between 8-19 days prior to the commencement of the event, client will be refunded 40% of the amound paid. In the event that the cancellation is notified to Wczasy Zeglarskie. Between 0-7 days prior to the commencement of the event.
VII.Amendment and cancellation by Wczasy Zeglarskie.
1. Wczasy Zeglarskie. makes every effort to operate its event as advertised but it may very occasionally be necessary to modify an event before its commencement. However, it guarantees that it will not do so for any reason other than force majeure after the date on which the final payment is due. Force majeure means unusual and unforeseeable circumstances beyond Wczasy Zeglarskie. control, the consequence of which neither Wczasy Zeglarskie. nor its suppliers could avoid, including, but not limited to, war, threat of war, riot, civil strife, terrorist activity (actual or threatened), industrial dispute, technical problems with transport, machinery equipment, power failure, natural or nuclear disaster, fire, flood or other adverse weather conditions. In the event of a cancellation due to force majeure, Wczasy Zeglarskie. will use reasonable endeavours to arrange an alternative course of a comparable standard. In the event that this does not prove possible or practicable, the Company undertakes to give an appropriate refund having regard to the circumstances.
2. Cancellation of the contract may occure in the event when client by his/hers own conduct, makes realisation of the event difficult or impossible, esspecially in a case of breaching a significant rules which will operate during the event; rules on the water: consumption of alkohol, drugs or any substance likely to cause intoxication is prohibited on the yacht or when client endangers life of the others by unreasoneble conduct.
VIII.Responsibilities of Wczasy Zeglarskie
1.Wczasy Zeglarskie. will be under no liability whatsoever if you suffer loss, death or personal injury where there has been no fault on the part of Wczasy Zeglarskie. or its employees, skippers, agents or suppliers and the loss, death or personal injury suffered is attributable to your own acts or omissions or to the acts or omissions of a third party not involved in providing the services which make up your course, or to unusual or unforeseeable circumstances or events which could not have been anticipated or avoided by Wczasy Zeglarskie. or its employees, skippers, agents or suppliers even with the exercise of all due care.
2. In all cases, liability and compensation are limited in accordance with the provisions of all international conventions which concern transportation and accommodation.
3.Every attempt will be made to give clients maximum sea time. However, if in the opinion of the instructor, weather conditions, safety or any other consideration renders it imprudent, the instructors decision is final.
IX.Excursions.
1.During the period of the event with Wczasy Zeglarskie, you may book an excursion or undertake an activity other than one arranged by Wczasy Zeglarskie. In such an event, your contract for such excursion or activity is with the local company providing that excursion or activity and not with Wczasy Zeglarskie. Wczasy Zeglarskie has no legal liability for anything that goes wrong on such an excursion or activity and any claim which you might have arising out of the same will be against the local supplier and be subject to its terms and conditions.
X.If you have a problem
1.If you are unhappy with any aspect of Wczasy Zeglarskie arrangements while on your course, you must address your complaint immediately to the pilot/resident of Wczasy Zeglarskie.
XI.Description of services
1. The Company maintains its latest and most detailed information relating to its services and courses on its website: WczasyZeglarskie.pl In the event of a client being provided with information which is in conflict with that stated on the Companys website, it is the website information that should be regarded as being correct, unless the contrary information is specifically confirmed to the client in writing.
XII.General
1. The contract to which these conditions apply and any matter arising from it are governed by the law of England and Wales, International Private Law and The Lugano Conwention.
